GENERAL PROVISIONS
The material that appears on www.drivemycar.net.au is for informational purposes only. Despite our efforts to provide useful and accurate information, errors may appear from time to time. Before conducting any vehicle leasing you should confirm any and all information regarding the car owner and/or car driver (including, where the lease of a vehicle, the monthly lease payments, inception fees, lease term, insruance premium amounts, excess Km charge, total allowed kilometres) that is important to your decision. Drive My Car is not responsible for, and does not guarantee the performance of, any such goods or services or information.
The Drive My Car lease-out process requires each party (Owner and Driver) to provide information essential to the lease-out. Such information may include an individual or company's name, address, phone number, e-mail address, Vehicle's description details, and other information ("User Information"). The Drive My Car Web Site accepts the User Information supplied by various Users, and Drive My Car assumes no responsibility for verifying the accuracy of such User Information, and does not endorse or approve of any vehicle, car owner or car driver. The User Information is used by Drive My Car to allow the car owner and prospective driver to contact each other so as to facilitate the lease-out process.
Drive My Car services are available to individuals and business. Individuals agreeing to be bound by this Visitor Agreement on behalf of a business must be an officer or agent of such business who is authorised to form legally binding contracts on behalf of the enterprise under applicable law. And any such person hereby certifies that is an officer or agent of such business. Drive My Car may also refuse to provide the Services to anyone or any entity at any time, in our sole discretion and Drive My Car reserves the right to deny use of this service to anyone who uses the service in manner we consider inappropriate.

INTERACTIVE AREAS
The Contact Owner Interactive Messaging System is provided to allow car owners and car drives a convenient means of expediting the lease-out process. Drive My Car does not endorse the accuracy of any message transmitted through the Interactive Messaging System . Please use your best judgment and be respectful to other individuals using this forum. Do not use vulgar, abusive, or hateful language. You may not use the Interactive Messaging System for advertising or promotional materials or other forms of solicitation not related to the applicable Listing.
Given the nature of the Service and the volume of messages and listings, Drive MY Car cannot monitor all messages transmitted though the Interactive Messaging System. However, please contact a Drive My Car customer service if you encounter any communication that is obscene, defamatory, or otherwise unacceptable. Drive My Car reserves the right to delete, move, or edit any communication that it deems in its sole discretion to be a violation of this Agreement or defamatory or insulting in any way.
VEHICLE LISTINGS
Drive My Car DOES NOT REVIEW vehicle listing posted on www.drivemycar.net.au . You can expect these areas to include information and opinions from a variety of individuals and organizations other than Drive My Car. We do not endorse or guarantee the accuracy of any listing. Responsibility for what is listed in www.drivemycar.net.au lies with each user. You alone are responsible for material you post. By using www.drivemycar.net.au you agree not to post or transmit any defamatory, abusive, obscene, threatening, misleading, or illegal material, or any other material that infringes on the rights of others or interferes with the ability of others to enjoy www.drivemycar.net.au . We retain the right to deny access to anyone who we believe has violated these terms or any other term of this agreement. You will not use the service to violate the copyright, trademark, or other intellectual property rights of any person or other entity. By submitting material to www.drivemycar.net.au, you are representing that you are the owner of the material, or are making your submission with the explicit consent of the owner.
OWNERSHIP OF LISTINGS AND COPYRIGHTS
You hereby grant Drive My Car a non-exclusive license to publish all listings you provide us. Drive My Car is not responsible for any damage or loss to any listings, copy, drawings, and art or any other materials you provide. You herby agree that by placing a listing on Drive My Car, you hereby grant a license to Drive My Car a non-exclusive basis, all copyrights and other ownership rights in the listing, including the right to publish, reproduce, display, adapt, transmit, or produce derivative works in any medium, including any digital electronic medium.
Registration
To obtain access to certain www.drivemycar.net.au services, you will be given an opportunity to register with Drive My Car. As part of the registration process, you will be required to enter a valid e-mail address and a password. You agree that the information you supply during that registration process will be accurate and complete and that you will not (i) register under the name of, nor attempt to enter the service under the name of, another person; nor will you (ii) adopt a user name that Drive My Car, in its sole discretion, deems offensive. You will be responsible for preserving the confidentiality of your password and will notify Drive My Car of any known or suspected unauthorized use of your account.
Applicant Transaction Fees
Drive My Car charges the buyer a $49.95 non-refundable listing fee when a vehicle is listed on www.drivemycar.net.au wesite.
Vehicle Listing Upgrade Fees
Choose several optional features to help promote and enhance your listing. Please note that these fees are non-refundable and some of them are for a limited time.
RATES
Drive My Car reserves the right to revise rates, terms and specifications contained in the current listing rates.
PAYMENTS
Credit Card
-We accept all major credit cards, including Visa®, MasterCard®, American Express®. Please be sure to provide the exact billing address and telephone number that your credit card issuer has on file for you. Incorrect information may cause a delay in the processing.
REFUND POLICY
ALL FEES BILLED AND COLLECTED BY DRIVE MY CAR ARE NON-REFUNDABLE.
Listing, Advertising and Promoting Fees
All processed and billed listing, advertising and promoting fees are Non-Refundable.
RESPONSIBILITY OF DRIVE MY CAR
Drive My Car shall display the listings submitted by you in www.drivemycar.net.au (the Site) subject to your listing remaining in good standing. Your listings will be placed in the Site's listing database, which may be accessed by visitors to the Site. Drove My Car reserves the right to reject and/or remove any listing submitted by you for any reason.
Special positions for your listing(s) are not guaranteed. However, some special positions may be available for a premium.
Posting a lease does not guarantee in any way that you will be successful in completing a lease-out for your vehicle.
IMPORTANT LEASE INFORMATION
Any outstanding lease payment and associated fees or charges that occur during the lease-out period are the responsibility of the car owner and car driver. Drive My Car is not responsible for any default payment that may occur between the car owner and car driver. However, for a fee, Drive My Car may assist individual parties in recovering outstanding payments, fees or charges.
IMPORTANT OBLIGATIONS
You guarantee that any listing you submit is truthful and in compliance with all copyright laws and all other applicable laws and regulations. You guarantee that you shall conduct yourself ethically in the use of the Site and in any transaction resulting from said use.
Disclaimer of Warranties and Limitation of Liability
IF YOU RELY ON THIS SERVICE OR ANY MATERIAL AVAILABLE THROUGH THIS SERVICE, YOU DO SO AT YOUR OWN RISK.
YOU UNDERSTAND THAT THERE MAY BE DELAYS, OMISSIONS, INTERRUPTIONS, INACCURACIES, AND/OR OTHER PROBLEMS WITH THE INFORMATION, PRODUCTS, AND SERVICES PUBLISHED OVER THIS SITE.
THIS SERVICE IS PROVIDED TO YOU "AS IS." DRIVE MY CAR AND ITS AFFILIATES, AGENTS AND LICENSORS CANNOT AND DO NOT WARRANT THE ACCURACY, COMPLETENESS, CURRENTNESS, NONINFRINGEMENT, MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE OF THE INFORMATION AVAILABLE THROUGH THE SERVICE (OR ANY INFORMATION, GOODS OR SERVICES THAT ARE REFERRED TO, ADVERTISED ON, OR SOLD THROUGH THIS SERVICE). NOR DO THEY GUARANTEE THAT THE SERVICE WILL BE ERROR FREE, OR CONTINUOUSLY AVAILABLE, OR THAT THE SERVICE WILL BE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
YOU EXPRESSLY UNDERSTAND AND AGREE THAT DRIEV MY CAR AND ITS AFFILIATES, AGENTS AND LICENSORS SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA OR OTHER INTANGIBLE LOSSES (EVEN IF WE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES), RESULTING FROM: (i) THE USE OR THE INABILITY TO USE THE SERVICE; (ii) THE COST OF PROCUREMENT OF SUBSTITUTE GOODS AND SERVICES RESULTING FROM ANY GOODS, DATA, INFORMATION OR SERVICES PURCHASED OR OBTAINED OR MESSAGES RECEIVED OR TRANSACTIONS ENTERED INTO THROUGH OR FROM THE SERVICE; (iii) UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR DATA; (iv) STATEMENTS OR CONDUCT OF ANY THIRD PARTY ON THE SERVICE; OR (v) ANY OTHER MATTER RELATING TO THE SERVICE.
YOU AGREE THAT THE LIABILITY OF DRIVE MY CAR AND ITS AFFILIATES, AGENTS AND LICENSORS, IF ANY, ARISING OUT OF ANY KIND OF LEGAL CLAIM IN ANY WAY ARISING OUT OF OR OTHERWISE RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID, IF ANY, TO THE SERVICE FOR USE OF THE SERVICE.
MISCELLANEOUS
No spamming. You agree not to gather any e-mail addresses through DRIVE MY CAR for purposes of spamming. By submitting material to Drive mY Car you are permanently granting Drive My Car all rights to the material, including the right to modify the material, to use it commercially, and to maintain the material in an archive. This Agreement has been made in, and shall be construed in accordance with the laws of New South Wales.
I certify that I am an adult (18 years old or older) have read the Visitor Agreement, accept all of its terms and conditions and can enter into this Agreement.
